Katzenstein v. Dollar General (No Temp After Termination)

Here, upon appeal by the Plaintiff, the appellate court finds in favor of Dollar General and affirms the lower courts ruling in denying temporary workers compensation benefits for a knee injury. Fired from his post due to leaving employees unsupervised, Katzenstein sought temporary disability benefits following a string of hospital visits in regards to his knee. Holding that, “an employee will only be entitled to temporary disability benefits if he/she can establish a causation between disability and the subsequent unemployment. Because Katzenstein was fired for cause and not an inability to work, this Judge affirmed the lower courts ruling.
